Fair Use Policy

1. Purpose

This Fair Use Policy is intended to ensure that all users of our service enjoy fair access, prevent abuse, maintain system stability, and protect operational costs. By using the Service, users agree to comply with this Fair Use Policy.

2. Scope

This policy applies to any usage of the platform where fees are calculated as a percentage of a transaction or service, especially where there are fee caps or thresholds in place (e.g., maximum limits on charges). It covers, but is not limited to:

  • Excessive frequency of transactions

  • Extremely large transaction amounts

  • Use of the service in a manner inconsistent with its intended purpose or in a way that may be considered abusive or exploitative

This policy applies whether the fee structure is:

  • Percentage-based

  • Flat-fee with a cap

  • Promotional or time-limited

  • Future models with similar characteristics

3. Definition of “Excessive Use”

A user’s usage may be deemed “excessive” if one or more of the following conditions apply:

  • Transaction volume or count is substantially higher than the average for comparable users

  • The usage causes undue burden on our systems or degrades service quality for other users

  • Structuring activity to consistently hit capped fees in a way that circumvents intended pricing

  • Using the platform in a way that simulates high-value transactions solely to minimize fees

  • Automated or systemized behavior to extract pricing advantages

  • Fee manipulation which includes any deliberate action or transaction intended to minimize or avoid fees contrary to their normal structure.

We reserve the right to determine, in our sole discretion, whether usage constitutes fee manipulation, excessive use or abuse based on transaction data and comparable users.  

4. Measures for Excessive Use

If a user is found to exceed reasonable usage under this policy, the Company may, at its sole discretion, implement one or more of the following remedies:

  • Impose additional charges or fees for the excess portion

  • Suspend or terminate service

  • Update fee caps or pricing specifically for your account

  • Require pre‑approval or special terms for continued high usage

We will always aim to notify you in advance where practical.

5. Notification & Transparency

  • Users whose usage approaches or exceeds acceptable limits will be notified (e.g. via email, in‑app notice, or SMS)

  • Details of what constitutes “excessive use” should be made available in the FAQ or Terms & Conditions

  • Users will be given an opportunity to respond or adjust their usage

6. Amendment & Exceptions

  • The company reserves the right to change this policy at any time. Notice will be given via our website, app, or user communications.

  • In exceptional cases (e.g. special customer agreement), alternate usage limits may apply, subject to mutual agreement.

  • The Company may periodically review transaction data and adjust fee caps, thresholds or other applicable terms to address new patterns of misuse or disproportionate usage.

This policy does not limit or replace other parts of our Terms of Service. All other rights and remedies, including for fraud or misuse, remain available.
